Terms and Conditions for Festive Offer
These Terms and Conditions (the “Terms”) apply to and regulate the promotional offer called ”Festive Offer” brought by ICICI Bank to its savings account customers and are in addition to and not in derogation of the Terms and Conditions for internet banking services of ICICI Bank (the “Primary Terms and Conditions”) as available on www.icicibank.com. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail. All capitalized terms used herein but not defined shall have the same meaning as specified under Primary Terms and Conditions.
DEFINITIONS

“Customer” shall mean a savings account holder of ICICI Bank (including NRE and/or NRO saving account), availing internet banking services of ICICI Bank through its website https://infinity.icicibank.co.in (“ICICI Bank website”) and who registers for the Program with ICICI Bank and fulfills the eligibility criteria set out by ICICI Bank during the term of Program Period in order to be eligible for the Gift as per the Terms.

“Participating Merchant Partner” shall mean the merchant participating in the Program and as specified by ICICI Bank from time to time.

“Gift” shall mean the gift offer brought to you by Participating Merchant Partner and specified by ICICI Bank at the time of registration of the Customer with ICICI Bank and shall be in accordance with the spend amount specified by the Customer or any other gift as shall be specified by ICICI Bank at its sole discretion subject to the Terms.

"Program” shall mean the Gift offer to the Customer by the Participating Merchant Partners on fulfillment of the eligibility criteria set out by ICICI Bank at its sole discretion during the Program Period.

“Program Period” shall mean the period commencing from 12th October 2009 to 31st December 2009(both days inclusive).

“User Agreement” shall mean the user agreement of the Participating Merchant Partner as defined on their respective Merchant Website.

“Merchant Website” shall mean the website of the Participating Merchant Partners as per the url specified herein below.

The Customer shall be required to fulfill the following criterion in order to be eligible for this Program-

a) the Customer shall be required to register online on ICICI Bank website for the Program with ICICI Bank on or before 30th November and shall be required to specify the amount which the Customer intends to spend (the “Spend Limit”) while transacting on the Merchant Website during the Program Period in order to be eligible for the Gift and shall also be required to indicate his/her choice of gift available at those spends slab(s) and as indicated by ICICI Bank.

the Customer shall be required to transact on the Merchant Website during the term of the Program Period to reach the Spend Limit specified by him/her at the time of registration with ICICI Bank and make payment through the account held by the Customer with ICICI Bank using ICICI Bank website, subject to the Primary Terms and Conditions and the Terms as shall be specified.

c) The following shall be the list of the products/services which when purchased by the Customer from the Participating Merchant Partners shall be considered for the purpose of calculating the Spend Limit specified by the Customer at the time of registration.

The Customer agrees and acknowledges that the registration with ICICI Bank for the Program is purely voluntary and does not create any obligation on ICICI Bank with regard the Program and the deliverables thereof and the Customer shall not be eligible for any Gift under the Program in the event the Customer is not able to reach the Spend Limit. The Customer also agrees that in the event he/she spends more than the Spend Limit specified at the time of registration or thereafter as per the Terms, the excess spend by the Customer shall not be considered for calculating the Spend Limit and the Customer shall only be eligible for the Gift as specified against the registered Spend Limit.

The Customer shall be allowed to verify the Spend Limit and/or the choice of gift available to the Customer till 30th November 2009. The last specified Spend Limit and/or the gift specified by the Customer on or before 30th November 2009 shall be considered to be final for the purpose of this Program. In the event of any inconsistency/issue in this regard, the decision of ICICI Bank shall be final.

The gift choices shown to the Customers in the display or at the time of registration are subject to change, without prior intimation to the Customers. ICICI Bank retain the right to change the choice of gifts available at specific spends slabs. ICICI Bank shall retain the rights to offer the Customer with an alternate gift from his/ her indicated choice, in case of any delay, damage or breakage, subject to availability of the Gifts and favorable conditions of delivery of Gifts.

ICICI Bank shall not be responsible towards delivery of the Gifts nor does it guarantee the quality of the Gifts.

The Customer shall be required to redeem the Gift at the end of the Program Period in the manner specified by ICICI Bank and /or the Participating Merchant Partner. ICICI Bank shall not be responsible towards delivery of the Gifts nor does it guarantee the quality of the Gifts. The Gifts shall be delivered only in India.

Additionally, the Customer shall also be eligible for additional gift items (the “Gift Items” ) from Zoomin Online India Pvt Ltd (“Alliance Partner”) on doing the first transaction of any amount on any of the Merchant Website except on the website of the Alliance Partner on or before 30th November 2009. In order to be eligible for this Gift Item, it is not obligatory on the Customer to achieve the Spend Limit specified by him. . The Customer shall be required to redeem the Gift Item in the manner specified by ICICI Bank and /or the Alliance Partner. The other para’s of these Terms shall continue to be applicable and binding on the Customer.

The Gift / Gift Items is non transferable, non-binding, non-encashable and non negotiable.

The Program is applicable only for resident and non-resident Indian Customers.

The Program shall be valid for purchases for which full payment has been made to the Participating Merchant Partners and has not been disputed or reversed later by the Customer.

Taxes, surcharges and other statutory levies will be charged to the Customer as mentioned in the listings on the respective Website’s of the Participating Merchant Partners.

All products and/or services shall be subject to availability at the time of purchase and will be governed by the User Agreement, policies, and the terms and conditions as displayed on the Websites.

The Program shall not be valid on cancelled or disputed orders. ICICI Bank reserves the right to reverse the Program in case the purchase is found to be cancelled or disputed later. ICICI Bank shall not be responsible or liable for any dispute or claims arising in this regard.

ICICI Bank reserves the right, at any time, without prior notice to add, alter, modify, all or any of the Terms or replace, wholly or in part, this Program by any other offer, whether similar to this existing Program or not or to withdraw it altogether.

Decision of ICICI Bank on all aspects with regard to administering the Program, shall be final and binding on all Customers.

ICICI Bank is neither responsible for nor guarantees the quality or delivery of the products / services / Gift / / Gift Items by the Participating Merchant Partner/Alliance Partner and shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any service availed of by the Customers under the Program.

ICICI Bank holds out no warranty or makes no representation about the quality, merchantability, delivery or otherwise of the products / services purchased on the Website or of the Gift / Gift Items delivered to the Customer under the Program. Any communication, dispute or claim regarding the product or service / Gift / Gift Items or the amount shall be resolved by the Customer with the Participating Merchant Partners as per the User Agreement and/or Alliance Partner directly without any reference to ICICI Bank.

The benefits under the Program cannot be clubbed with other offers running on the Participating Merchant Partner Websites / Alliance Partner’s website or ICICI Bank’s website. In case of any dispute or discretion in this regard, the decision of the Participating Merchant Partner's / Alliance Partner or ICICI Bank as the case may be shall be final and binding on the Customers.

Any disputes arising out of this Program shall be subject to the exclusive jurisdiction of competent courts in Mumbai.

The Program shall not be available wherever it is prohibited under law and / or cannot be offered for any other reason whatsoever.

The Participating Merchant Partners/ Alliance Partner do not warrant that the Websites/ Alliance Partner’s website shall run concurrently and error free during the Program Period and does not commit any uptime of Websites / Alliance Partner’s website. Further the Participating Merchant Partners / Alliance Partner shall not be liable for technical or human error.

The Customer agrees that participation in the Program is good and sufficient consideration, and be bound by these Terms and Conditions.
